How to access litigation funding

If a claimant/respondent with a meritorious commercial litigation or arbitration dispute lack the funds or would prefer not to tie up the funds necessary to finance the pursuit of the case, litigation funding can provide a cost-effective financing tool and a valuable means to access justice. While claimant/respondent may sacrifice a proportion of any financial reward recovered if the case is successful, and face no downside if the case is unsuccessful.

 

An interested claimant/respondent will go through the assessment on the claim to evaluate its chances of success and likely costs. This initial screening process, which will be carried out by us considers a number of factors: merits, quantum, recoverability, time, costs, and variability. Should potential cases pass the initial screening process, the claimant/respondent will undergo a due diligence process and once this has been completed, we will determine if it considers this opportunity as suitable to pursue.

 

If we consider that the claimant/respondent’s claim is meritorious, it will then enter into Funding Agreement with us. The funder’s share of the proceeds of a success case is negotiated with the litigant at the outset. This financial reward typically comprises of either a percentage of the damages recovered, or multiple of the sum advanced by the funder, or a combination of the two.[/vc_column_text][/vc_column][/vc_row]
